Overview
Jonathon Nicol is an accomplished business trial and appellate attorney with more than two decades of litigation and corporate experience, representing clients in civil lawsuits and arbitrations. Licensed since 2005, Jonathon brings both trial and appellate depth to his practice, having tried and appealed matters in state and federal courts and before arbitrators throughout Missouri, Kansas, California, Florida, and Texas. He represents both plaintiffs and defendants, and is known for a results-driven approach that balances aggressive advocacy with practical, client-centered judgment.
Prior to joining Kennyhertz Perry, Jonathon spent 15 years at large international law firms representing some of the world's largest companies before founding The Nicol Law Firm in 2020 to serve individuals and small and medium-sized businesses. At The Nicol Law Firm, Jonathon represented clients across trials, commercial litigation, corporate law, and appeals, and also served as outside general counsel for businesses in the health, cannabis, and professional services industries. His seasoned perspective blends deep corporate and institutional experience with an entrepreneurial sensibility — helping clients start and run businesses, protect their interests, and navigate complex disputes with clarity and purpose.
Jonathon has also testified as an expert witness on legal ethics and professional responsibility, and operates a certified mediation practice, where he regularly serves as a neutral under the Western District of Missouri’s Mediation and Assessment Program.
He is admitted to practice before the federal United States Courts of Appeals for the Eighth and Ninth Circuits, the United States District Courts for the Western District of Missouri and the District of Kansas, and the Northern, Eastern, Central, and Southern Districts of California.
Nicol Secures Complete Defense Victory in JAMS Arbitration for Healthcare M&A Firm and Its Executive
Jonathon Nicol secured a complete defense victory on behalf of his client sin a JAMS arbitration proceeding decided on June 15, 2026.
The arbitration arose out of a proposed acquisition of two California-based medical practices. Mr. Nicol's clients, a healthcare-focused M&A firm and its individual co-founder and executive, were brought into the proceed in as cross-respondents by the medical practices, which sought indemnification from the M&A firm and its executive to the extent the medical practices were found liable to a third-party financial consulting firm for fees alleged to be due under an professional services engagement agreement.
The Arbitrator's award resolved every claim against Mr. Nicol's clients fully and favorably. All claims against the individual executive in his personal capacity were dismissed in their entirety during the arbitration hearing. The indemnity cross-claim brought against the M&A firm, which sought to shift any financial liability onto Mr. Nicol's clients, was denied in full.
As a result of the award, Mr. Nicol's clients bear no financial liability in connection with this proceeding.
"This was a significant result for our clients," said Mr. Nicol. "They were pulled into a dispute that was fundamentally between other parties, and we were committed to demonstrating that there was no legal or factual basis to impose liability on them. The Arbitrator's award reflects that."

Jonathon earned his J.D. in 2005 from Santa Clara University and his B.A. in 2001 from Boston University.
